General Terms and Conditions of Sale

These General Conditions of Sale (hereinafter “GTC”) apply to the sale of products from the site https://www.myjapanbox.com/ and define the rights and obligations of the seller and the customer within the framework of the online sales.

The pictures accompanying the products are provided for information only and have no contractual value.
The pictures in the catalog are as faithful as possible but cannot ensure a perfect similarity with the article offered, in particular with regard to the colors.
3. PLACE AN ORDER
MJB’s website and advertising constitute an invitation only. Ordering goods (online or otherwise) constitutes an offer to purchase by the customer in accordance with these terms and conditions. The contract takes effect upon confirmation of payment.
For the purpose of placing an order, the customer is invited to follow the following steps:
1. Create your basket
The Customer must add the products he wishes to purchase to his basket.
The prices displayed in the basket are indicated in euros, US dollars, AU dollars and pounds sterling, taking into account the VAT applicable on the day of the order, any change in the rate will be reflected in the price of the items including all taxes.
2. Creation of a customer account
It is preferable for a user to create his customer account before placing an order. This feature allows our customer service to better track deliveries.
When creating their customer account, the Customer will be assigned connection identifiers (identifier and password chosen by the latter). These identifiers are strictly confidential and should not be communicated to third parties. The protection of these identifiers is the responsibility of the Customer and the responsibility of MJB can under no circumstances be sought in the event of the theft of these identifiers by a third party or theft of the identity of a customer.

3. Terms of delivery
The Customer must then indicate his identity and his delivery details. The Customer must inform the seller without delay of any modification of his data that could have an impact on the delivery of his order or on the invoicing of the latter.
The seller cannot be held liable in the event of an incomplete or incorrect delivery address on the part of the customer, who undertakes to bear the costs of return and redelivery to the correct address. For more information on delivery terms, the customer is invited to refer to Article 8 hereof.
The customer must choose the various delivery methods. MJB draws the attention of the customer to the fact that it does not manage the stocks of the products or the transit thereof. The delivery times and methods therefore depend on our chosen resellers and delivery services.
Before proceeding to payment, the customer must accept these GTC by checking the box provided for this purpose. This validation implies acceptance of all of these GTC. Any order by the customer implies acceptance of the prices and descriptions of the products purchased.
The contract takes effect upon confirmation of payment.
MJB remains the owner of the products until their full payment.
Following payment, the customer will receive an email summary of his order.
In case of partial availability of the products of the order, the Customer will have the choice either:
To confirm the maintenance of his order for the available items;
To replace the missing products with similar products offered by the seller;
Our products are offered within the limits of available stocks. In the event of an item being out of stock, we reserve the right not to ensure delivery of your order and we undertake to inform you as soon as possible.
However, if a product should be withdrawn for any reason by production, MJB will withdraw the product from sale as soon as possible. This action can in no case give a right of action in your favor.
In the event of a dispute concerning the payment of a previous order, MJB reserves the right to block your order. You can then contact MJB customer service to resolve the dispute and unblock your new order.
4. ORDER PREPARATION AND CONTROL
1. Preparation time
An order with classic shipment is prepared and sent the first week of the month following the order.
Only orders with express shipping are prepared in 5 working days. However, order preparation can take up to 10 days if there are re-ordering issues due to delays for popular items, pre-order items, or related to exceptional events like COVID-19 or busy times like Christmas and the new Year parties.
2. Errors and omissions
MJB will inform the buyer as soon as possible of any errors or omissions discovered and will give the buyer various possibilities to settle this dispute.
3. Fraud prevention
MJB reserves the right to carry out checks on orders placed by customers, in order to meet its obligations in terms of fraud prevention and money laundering.
MJB may ask the customer to provide any document attesting to the reality of the customer’s identity and his domicile. As part of an inspection carried out by MJB, no order will be processed without receipt of the documents requested by MJB from the Customer.
In the absence of a response from the customer or supply from him of the requested parts, MJB reserves the right to cancel his order. He will then reimburse the sums paid by the Customer within thirty (30) days of the notification of refusal to process the order.
5. PRICE AND PAYMENT
The prices of our products are indicated in Euros, US Dollars, AU Dollars and Pounds Sterling, taking into account the VAT applicable on the day of the order, any change in the rate will be reflected in the price of the items.
MJB reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the Customer. All prices are subject to obvious typographical errors.
If an obvious error should occur, MJB will contact you to notify you of the error made by its services and remind you that the order will be invoiced under the corrected conditions.
However, in case of refusal of the corrected conditions, you will be free to cancel the corrected order without penalty.
Temporary promotions are indicated on the site https://www.myjapanbox.com/ and on the product sheet, including the dates of application of the reduction. Discounts and promotions are not cumulative and are only applicable once per household.
3. Terms of payment
Any ordering involves payment from the Customer.

1. Delivery rates
Shipping costs include preparation and packaging costs as well as postage. Preparation costs are fixed, while transport costs vary according to the total weight of the package.
We recommend that you consolidate all of your items into one order. We cannot combine two orders placed separately and shipping charges apply to each of them. Your package is shipped at your own risk, but special attention is paid to fragile items.

Preparation and delivery are only carried out after full receipt of payment. The seller delivers the products within the deadlines indicated when placing the order. Delivery is made at the risk of the seller.
The customer will be notified by email of the shipment of his order, indicating, if applicable and depending on the delivery method chosen, the tools for monitoring his delivery.
3. Delivery times
MJB is NOT a delivery company and uses the delivery services of other companies. Whatever your choice of shipping, a link to track your package online will be provided to the customer systematically.
Delivery times vary depending on the delivery method chosen by the customer (Japan Post, EMS, DHL, DHL Express).
The delivery times following the validation and preparation of an Order are as follows, as an indication, on working days:
– Japan Post: 15 to 20 days.
– EMS Express: from 7 days to 15 days.
– DHL EXPRESS: 4 to 5 days.
The advertised shipping times are the order processing times plus the shipping time. All like the preparation times of 5 working days, can be exceptionally extended the delivery times:
Due to the COVID-19 epidemic, impacting deliveries;
In summer periods and when there are large crowds;
During public holidays;
In case of force majeure.

4. Receipt of the order
Orders are delivered to the address specified by the customer when placing the order. Any order returned to the seller due to an error in the delivery address will be reshipped at the customer’s expense.
5. Parcel damaged or lost in transit
Upon receipt of his order, the Customer must check the conformity of the products received with the carrier. In the event of a damaged or deteriorated package, or a missing product, the customer must specify this on the carrier’s delivery slip on the day of receipt of the order.
If the package has been torn or opened, the customer must check the condition of the products. If they have been damaged, the customer must refuse the package and note a reservation on the delivery slip indicating any anomaly concerning the delivery.
While no liability for goods damaged or lost in transit is accepted by Seller, details of any claims should be communicated to Seller.
This verification is considered to have been carried out by the Customer as soon as the latter, or a third party authorized by him for this purpose, has signed the delivery note.
In the event of a lack of conformity or a hidden defect noted by the customer at the time of delivery of his order, the latter must contact the seller’s customer service as soon as possible, indicating his order and invoice number, its identity and the description of the nonconformity.
The risk of loss and deterioration of the products will be transferred to the customer upon delivery and receipt of said products.
In the event of a lost package, the Customer – who has not received his package – must contact MJB customer service. The customer will be kept informed of the further processing of his order.
Duties, taxes and charges are not included in the price or even in the cost of shipping the order. Customs charges depend on the rules of each country and are the responsibility of the customer in the event that this happens.
The seller does not provide its customers with any additional guarantee other than the legal guarantees of conformity and latent defect.
The Customer is invited to notify the seller of any damaged package, missing or damaged products or non-conforming to the order and this within 24 hours of receipt of his order. Any complaint made exceeding this deadline cannot be accepted.

The exchange will only be possible under the following conditions:

In case of contrary use or misuse, no guarantee will be due. MJB cannot be held responsible for damage or accidents caused by the products distributed.
8. ORDER CANCELLATION
The cancellation fee will be 30%.
Due to several cases of abuse, each request has to be examined first.
We order products according to your orders. Too much abuse in the past forces us to be stricter so we don’t end up with thousands of unsold and perishable products, especially in a difficult context since COVID-19.
If you want to cancel/interrupt your subscription, you have to do it by yourself with your personal account and with your bank/Paypal/Stripe account. If you don’t confirm on both sides, the payment will be automatic. We can’t do it automatically, this is from the customer’s side.
Please don’t forget to validate the cancellation (usually at the bottom of the page). We got many emails from people who thought they did cancel their subscription, but without validating the cancellation, your subscription won’t stop.
If you decide to open a case with PayPal/Stripe, note that they have the final decision about the claim. Most of the time, the claim is closed since the claim is considered non-receivable. If your request of being refunded has been received, it would take several days to appear. Please note that if you used PayPal, we wouldn’t be able to refund you at 100% since PayPal takes a commission on your purchase.
Above 6 months, we can’t refund you on Paypal. We’ll have to do a classic bank transfer.
If you want to cancel your order, you will be refunded by bank transfer, shipping costs are not refunded. Please note that using PayPal involves a commission on your purchase, which will also not be refunded.
9. ORDER WITHDRAWAL
The individual Customer has a period of fourteen (14) days from receipt of the Product to exercise his right of withdrawal, for any reason whatsoever, in order to obtain a refund for the Products purchased.
To facilitate the management of your return and for better service, we advise you to send your withdrawal request to our customer service by email at ([email protected]). Each withdrawal request will be analyzed by our team. MJB reserves the right to cancel or confirm such withdrawal.
Each product sheet indicates which product (s) benefit from the exemptions from the right of withdrawal.
Returns are to be made exclusively to the seller concerned under the following conditions:
- Produced in its original packaging;
- Product not deteriorated;
- Unused and unworn product;
- Purchase invoice attached (or copy in case of partial return);
- Delivery form.
Items damaged, soiled or deteriorated by the customer will not be taken back.
The return costs will be borne by the customer. Any risk associated with the return of products is the responsibility of the customer. The products must be returned – by the carrier of the customer’s choice – to the address of the seller’s headquarters, indicated on the invoice.
The product (s) must be returned to our logistics address: My Japan Box, 1-1-30 Sakuragawa, Naniwa-ku, Osaka 556-0022, Japan.
The customer will be reimbursed for the sums paid – minus the reimbursement of return transport costs – by transfer to his bank card, within fourteen (14) days of receipt of his request to exercise his right of withdrawal. .
10. MAJOR FORCE
Neither MJB nor the customer can be held responsible for their delay or failure in the performance of their contractual obligations if this delay or failure is due to the occurrence of an event beyond their control (breach of stock or unavailability of the product, disruption or total or partial strike including means of transport and / or communications, in the event of flood or fire or natural disaster) or a case of force majeure, which could not be reasonably foreseen when the order is placed and the effects of which cannot be avoided by appropriate measures.
In the event of such a case of force majeure, the execution of these GTCS will be suspended until the disappearance, extinction or cessation of the case of force majeure. However, if the force majeure persists beyond thirty (30) days, the customer and the seller must get together to discuss a possible modification of the order.
The deadlines provided for in these GTC will automatically be postponed depending on the duration of the case of force majeure.

11. INTELLECTUAL PROPERTY

12. MISCELLANEOUS CLAUSES
Severability: If one or more provisions of these T & Cs are held to be invalid or declared void in application of a law or a regulation or following a court decision authorizing res judicata, this does not remit in question the other clauses of the GTC.
Non-waiver: The fact that the seller or the Customer has not invoked a breach by the other party of one of the obligations referred to in these GTC will not be interpreted for the future as a waiver of the obligation in question.
Partial nullity: In the event of a contradiction between a stipulation of the GTC and any legislative text, law, ordinance, regulation, court order or collective agreement, present or future, the latter shall prevail, provided that the stipulation hereof thus affected is limited only to the extent necessary and no other stipulation is affected.
13. REFERENCING OF OFFERS
The products offered for sale on our site must comply with the following conditions:
- All products are new and are not stolen goods;
- They do not contravene the regulations in force;
- They are neither discriminatory nor inciting to violence, racial, religious or ethnic hatred;
